Are You Certain Your Website is ADA Compliant? (Whitepaper)

ADA compliance — or compliance with several government regulations regarding website access including Section 508 of the Rehabilitation Act of 1973, as amended in 1998 and 2017 — is generally regarded as a box on a checklist in the design and creation of many websites.

But is that level of attention enough to satisfy the requirements of the law?

As you may know, we have a company called 360Civic that focuses exclusively on public sector projects. When a website is for a city, a school or a utility, one that will be accessed by tens of thousands of people throughout a community, the need for ADA compliance is critical.

But it should be no less critical for a private sector site – as Target discovered. The retailer paid more than $3 million in fines plus $6 million in additional compensation because its site was not accessible for the visually impaired.

That kind of out-of-pocket expense should be motivation enough. But the best reason for compliance is the fact that every website should be usable for every person that visits. Very few facilities managers would sanction a building without accommodations for the disabled, not just because it is the law, but also because it is not fair to not provide equal access. A website must be approached with the same consideration: not providing access to people with disabilities is just as harmful.

360 has created a new whitepaper entitled ADA for Private Sector Websites: Why Compliance is Essential, and What is Required to Achieve It. The whitepaper focuses on the strategy of ADA compliance, usability and related laws, and how they apply to design and user experience. It is not intended as a legal document, but as a design strategy and primer to help you understand the issues and possibilities inherent in implementing a compliant site.
